(1) to a laboratory in exchange for clinical laboratory services; or (1) A hospital`s remuneration to a physician to compensate a non-medical physician for the provision of patient care, if all the following conditions are met: health care providers often have difficulty meeting the requirements of the Stark Law exemption for personal services. While technical defects (such as non-performance of a contract with the doctor) are common, the most common material offences generally fall into one of two categories: (1) Non-establishment of documentation that services were actually provided and (2) non-determination of compensation adequacy. (13) The transfer of goods or services is carried out and all conditions in this paragraph (w) are met on or before 31 December 2021. (1) General compensation of an institution, under an agreement or several agreements, to a doctor or family member or group practice, including the compensation of certain medical benefits served at a non-profit blood transfusion centre, if the following conditions are met: (A) The non-physician replaces a non-physician who has terminated his or her employment or contract agreement in order to provide care to patients or the medical organization) whose shoes are placed by the doctor) within one year of the start of employment or contractual agreement; and (4) Before receiving items and services, the physician pays 15 per cent of the donor`s costs for items and services. The donor (or a party related to the donor) does not finance the payment or loan of the doctor which must be used by the doctor to pay for goods and services. 6. Neither a physician`s suitability for goods or services, nor the amount or type of goods or services, is determined to take into account the volume or value of intermediate referrals or other transactions generated between the parties. 2. The agreement must cover all benefits to be provided by the doctor or the doctor`s direct family member (but there may be several contracts if they are incorporated into each other by reference and are kept on a master list of all relevant contracts); (10) Goods and services do not include the occupation of medical practices and are not used primarily for the exercise of a personal or professional activity that has nothing to do with the medical practice.
